InkSwift ("InkSwift", "we", "us") is a product operated by Danielle DuBois LLC. These Terms govern your access to and use of the InkSwift website, apps, and services (the "Service"). By creating an account or using the Service, you agree to these Terms.
You must be of legal age in your jurisdiction and, if signing on behalf of an organization, have authority to bind it. You are responsible for the accuracy of the information you provide and for safeguarding your account credentials and all activity under your account.
InkSwift lets you prepare, send, sign, and store legally binding electronic agreements, optionally with notarization. We grant you a limited, non-exclusive, non-transferable right to use the Service in line with your selected plan.
You agree not to misuse the Service. You will not:
We retain all right, title, and interest in the Service, including software, branding, and documentation. You retain ownership of the content and documents you upload. You grant us a limited license to host and process that content solely to provide the Service.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, currency, taxes, cancellation, and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy. Subscriptions renew automatically until canceled.
We work hard to keep the Service reliable, but we do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated policy violations. You may cancel at any time via your account or Paddle's buyer portal. On termination, you may export your documents for a reasonable window before deletion.
To the maximum extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, special, or punitive damages, including lost profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where prohibited by law.
You will indemnify and hold harmless Danielle DuBois LLC from claims arising out of your content, your unlawful use of the Service, or your breach of these Terms.
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware.
We may update these Terms from time to time. Material changes will be communicated via email or in-product notice. Continued use of the Service after changes take effect constitutes acceptance.
